Draft employment contract localised as per Bahrain Labour Laws.
Following your recent communication and subsequent discussions, I am pleased to confirm your appointment as XXXwith XXX; a Company registered in Bahrain, and will be reporting to XXX.
Period : Two years effective from xx-xx-xxxx.
Status : Family (Self & Wife + X Kids)
Designation : XXX
Job Posting : XXX
Job Description : As above and as designated by Management from time to time.
Products : All Products of XXX.
Salary : Basic BD XXX/- per month (no links to currency fluctuation).
Special Clause : After successful completion of initial 3 months there would be a revision of BD XXX in Basic.
Other Allowances : BD XXX/- per month.
House/Rent Allowance : Monthly accommodation allowance of BD XXX/- per month (not applicable if accommodation is provided by Company).
Vehicle Allowance : As per Company policy.
Fuel Allowance : BD XX per month to cover petrol expenses and small incidental maintenance
(applicable upon obtaining Bahraini driving licence and Company car). Regular/periodic maintenance and cleaning to be born by Company.
Telephone Allowance : BD XX/- per month
Commission : As per pay plan defined by Company from time to time.
Utilities : Included in accommodation allowance.
Rates : Included in accommodation allowance.
Transport : Not applicable.
Working Hours : Sunday – Thursday 8:00 hrs to 13:00 hrs and 14:00 hrs to 17:30 hrs.
Saturday 14:00 hrs to 17:30 hrs. This could change as per Company policy.
Leave : 30 days per annum (not working days). Leave cannot remain untaken. It can accumulate and remain untaken for a maximum period of 22 months, after which it has to be taken but within the contract period.
Sickness : Allowed 15 days per annum for proven sickness at full pay. Next 15 days at half pay (Government/other Medical Hospital Certificate required). More sickness days will be deducted in full.
Calculations : 1. Daily Pay = Monthly Basic x 12 x 365
a. Overtime is not applicable, although may be required from time to time.
Absences while in active work are deducted from basic monthly salary and allowances (where applicable and as per Company policy). When going on leave during the course of a month, salary will be paid on pro rata basis for that part of the month based on the deduction principle of days not worked.
Travel time is own time.
We reserve the right to count leave days from the real starting day situation and actual departure even if this coincides with it being an official holiday.
We reserve the right to pay leave entitlements only on an annual basis (no fragmentations) provided also that leave is actually taken. If leave is not taken, we may withhold the entitlements until it is taken.
Indemnity : A pay award equal to 15 days per annum payable at the end of each contract. Not applicable if terminated by employer earlier due to violation of special conditions below. Not applicable if terminated by employee before expiry of contract.
Medicals : Not applicable (almost free medical treatment as offered by Bahrain Government Hospitals)
Education : Not applicable.
Tickets : You and your family (Self + Wife +X Kids) are entitled for tickets every year to your country at the most economical rate to the Company. A ticket/cash allowance scheme may be introduced in lieu. Excess baggage is not reclaimed from the Company. Not applicable if terminated by employer due to violation of special conditions by employee prior to contract expiry. Not applicable if terminated by employee prior to contract expiry and in either of these cases all initial associated recruitment costs borne by the Company (ex. Labour and Immigration visa costs and any air ticket used including the first section when the employee joins….etc) will be reclaimed from you. If contract renewed then a 2 way return ticket from (and to) Bahrain will be provided.
Labour Laws : All Bahrain Labour Laws unspecified here shall constitute an integral part of this agreement.
Termination : 60 days notice by either party at anytime except during probation period and in the case of gross misconduct by the employee which , if proven , will result in summary dismissal and in this case and also in the case when the employee terminates the contract before its expiry, then the employee will have to reimburse the Company all costs associated with recruitment and training and/or any investment made on him by the Company.
Company By-Laws : The employee will adhere strictly to all Company by-laws at all times. These are published/circulated from time to time by the Management and Directors/Managers and are in the Company bulletin file with the Chief Accountant and a request to see the file can be made to the Chief Accountant at any time. Ignorance of their existence or lack of knowledge of the by-laws therefore will not waive responsibility to any violation of same and will not be acceptable.
Special Conditions :
a) Honesty, good conduct, keeping Company secrets and confidential information and the fulfillment of all duties given represent a basic condition of employment and any violation of this will result in disciplinary action and/or summary dismissal/termination.
b) Any investment/training costs spent on the employee is made based on the assumption that there will be at least an 18 months continuous service after the occurrence of such investment/training. If this condition is not adhered to then all such associated/incurred costs will be reimbursable to the Company.
The failure of either party to enforce at anytime, any of the provisions hereof shall not be construed to be a waiver of such provisions nor a waiver of the right of such party thereafter to enforce each and every such provision.
The Company has the right to withdraw/alter/change any scheme that comes under the term “Allowance” or “Commission” or “Bonus” in this contract at any time, and hence at no time schemes such as these, if given, should be considered as an inherent part of the salary, nor be treated as regular monthly income and/or salary. These allowances are irregular expenses given by the Company, and can be changed/altered/cancelled as per Company policy/discretion at any time.
This contract is deemed renewed for a similar period with the same terms and conditions, if no intimation is given otherwise.
